The Government response to the select committee includes acceptance of the Committee’s recommendation to maintain existing mechanisms for communicating and engaging with local government during and immediately after the UK’s withdrawal from the EU and commits to ensuring appropriate mechanisms are in place throughout the implementation period and negotiations on a future relationship.

The Commons Select Committee in its report "Local Government Governance and Accountability" has stated that Government has not done enough to ensure that, at a time when local authority budgets are under extreme pressure, governance systems are improved.

The government legislated for a cap of £95,000 on exit payments in the public sector in the Small Business Enterprise and Employment Act 2015 as amended by the Enterprise Act 2016. The government is now consulting on the draft regulations to implement the cap. The exit payment cap includes redundancy lump sums and pension top-up payments. It also includes pension strain (when there is a cost to employers if an employee leaves a post early) which will see the cost of the strain included in an employee’s pay out thus reducing it. LLG are looking to respond to the consultation and want your views to inform it.

Even by early morning last Friday, it was clear that there had been a huge change in the composition of many councils across the country; some changing to a different group altogether, and many moving to a position of No Overall Control; or a different composition of NOC. Some authorities who have been with one party for decades, find themselves under different leadership. The 2018 Map of Local Authority Political Control has been ripped up and is in the bin. What does this mean in practical terms?

The Local Government Legal Society was one of the forerunners to LLG. It was disbanded in 1976 when the organisation became part of the Law Society. The Local Government Legal Society Trust (the Trust) came into existence at that time and is administered separately from LLG. The objects of the Trust are to: “To promote and develop the role of solicitors, and trainee solicitors employed in local government in legal, managerial and administrative capacities and to take appropriate action on all matters concerning their training professional development duties responsibilities remunerations and interests”
LLG are entitled to nominate one Trustee to the Trust when the current seat becomes vacant. LLG are now looking to recruit and appoint a trustee to fill this very important position.

The Criminal Procedure Rule Committee has extended an invitation to LLG to comment on proposed new rules providing for the exercise of judicial functions by authorised court officers. We want to hear your views on the proposal.

Following requests for clarification on calculating the date of a councillor’s retirement or start of their term of office after scheduled local elections on 2 May 2019, the Association of Electoral Administrators and Lawyers in Local Government have sought legal opinion on the ‘effective fourth calendar date’ under the Local Government Act 1972.
